Terms and Conditions: The Creative Pause Club ( “little art / Harriet Norwood Poole”)

Please read the following terms and conditions carefully before joining The Creative Pause Club ("the Club"). By becoming a member, you agree to be bound by these terms and conditions.

1. Membership Eligibility / Registration / Code of Conduct:

1.1 To become a member of The Creative Pause Club, you must be at least 18 years old.   

1.2 Membership is open to individuals worldwide.

1.3 Membership is personal and non-transferable.

1.4 To join the Club, you must complete the registration process by providing accurate and up-to-date information. You agree to maintain the confidentiality of your account details and promptly update any changes to your personal information.

1.5 Participation in the club involves live online sessions, which will be recorded and shared in the membership. By taking part you agree to being recorded in an online session, your voice, physical appearance, creative mindfulness work, image, words in the chat functions or other forums, whatever you share, we will not edit such materials for distribution in the membership on the request of the member. We reserve the right to remove member provided content from live sessions not in compliance with these terms and conditions.

1.5 You agree to use the Club and its resources in compliance with all applicable laws and regulations. You will not engage in any unlawful, harmful, discriminatory or fraudulent activities while using the Club.

1.6 You agree not to engage in any activities to promote your own commercial services or products, either publicly in any forums, or in contacting members privately. This includes any research or beta testing of any products or services. You also agree not to share third party links without permission of the membership owner, little art.

2. Membership Benefits:

2.1 As a member of The Creative Pause Club, you will have access to a range of creative mindfulness resources, videos, audio files, courses, PDFs,  community forums, and other materials. You will also have access to live ( and recorded) sessions, as of writing, weekly sessions Tuesdays 8:30-9am and 12pm CET. 

2.2 The Club may also offer exclusive coaching discounts, promotions, or special events to its members. These discounts/ offers may differ between Founding Members and Members.

2.3 The Club reserves the right to modify, update, or remove any membership benefits without prior notice. However, the Club will strive to provide reasonable notice of any significant changes that may affect your membership experience.

3. Membership Fees and Payment:

3.1 The Club offers various membership plans, each with its own associated fees. Membership fees are payable in advance and are non-refundable, except as expressly stated in these terms and conditions.

3.2 The Club may modify the membership fees at any time. Any changes in fees will be communicated to members in advance. Pre-paid block payments will not be amended during the duration of the block.

4. Cancellation and Termination:

4.1 You have the right to cancel your membership at any time with pay monthly. However, membership fees are non-refundable and non-transferable. Block bookings  of more than one month are non-refundable and non-transferable, including the start and end dates.

4.2 The Club reserves the right to terminate or suspend your membership at any time, without prior notice, for any violation of these terms and conditions or for any other reason deemed appropriate.

4.3 In the event of termination or suspension of your membership, you will not be entitled to a refund of any membership fees.

4.5  Live sessions cancellation : In case of facilitator sickness the Pause & Play session will be rescheduled for the same week, or as close to as possible. In the event there is an ongoing health or other personal issue with the facilitator in the first instance a cover facilitator will be sought, in the second instance pre-recorded material may be provided where possible during the period of absence.

4.6 Public holidays cancellation : Live sessions will take place on the set days, excluding public holidays in Berlin, Germany, when there will be extra prompts provided instead. 

4.7 We reserve the right in time of any force majeure or legal rulings during pandemics to not be liable for any inability to continue to deliver the services. We will retain any fees already paid and provide these services within one year from the date of the enforcement of any legal ruling regarding a pandemic or force majeure event, that is preventing continuing the service.

5. Intellectual Property:

5.1 The Creative Pause Club and all associated materials, including but not limited to content, logos, designs, and trademarks, are the intellectual property of the Club, little art or its licensors.

5.2 As a member, you are granted a limited, non-exclusive, non-transferable single license to access and use the Club's materials solely for your own individual and personal, non-commercial purposes only. This single personal use licence does not permit use in educational or any coaching, consulting or other professional contexts. Any requests for a commercial, educational, commercial or other professional use licence must be made in writing, and any applicable fee will be due. 

5.3 You may not reproduce, distribute, modify the Club's prompts or other materials.

5.4 You may not download, modify or distribute any material in written, visual, auditory or moving image form created by other members.

6. Privacy and Data Protection:

6.1 The Club respects your privacy and will handle your personal information in accordance with applicable data protection laws and the Club's Privacy Policy.

6.2 By becoming a member, you consent to the collection, use, and disclosure of your personal information as outlined in the Club's Privacy Policy.

7. Disclaimer and Limitation of Liability:

7.1 The Club provides creative mindfulness resources and materials for informational and instructional purposes only. Participants take part at their own risk, and as so, are responsible for their own wellbeing including their choice of resources.  The resources provided may be therapeutic, but The Club does not provide medical, or professional trauma related mental health advice or services.

7.2 The Club does not guarantee the accuracy, completeness, or usefulness of any content or materials provided. You acknowledge that your use of the Club's resources is at your own risk.

7.3 The Club is not liable for any third parties eg Facebook or other forum provider’s use of any material uploaded by members as part of The Club.

7.4 The Club and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your membership or use of the Club's resources.

8. Modifications to Terms and Conditions:

8.1 The Club reserves the right to modify these terms and conditions at any time. 

8.2 It is your responsibility to regularly review these terms and conditions. By continuing to use the Club's resources, you accept any modified terms and conditions.

9. Governing Law and Jurisdiction:

9.1 These terms and conditions shall be governed by and construed in accordance with the laws under the Jurisdiction of Berlin, Germany.

9.2 Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.
